1. Purpose

These Terms of Service (Conditions Générales d’Utilisation, “CGU”) govern access to and use of the KRED platform (the “Service”), available at trykred.com. Access to the Service requires express acceptance of these Terms of Service: when the account is created or, for an account that already exists, upon the re-acceptance required by a new binding version. This acceptance is time-stamped and retained by KRED.

2. Description of the Service

KRED is a CPM (cost per thousand views) platform that enables content creators to monetise their TikTok, Instagram or YouTube videos as part of campaigns organised by partner brands. Creators submit links to their videos; KRED measures the views every day, for a maximum of 30 days after publication, and credits a Wallet in euros on the basis of the CPM applicable to the campaign’s platform, up to the limit of the campaign’s budget.

3. Conditions of access

Access to the Service is reserved for adult natural persons. Sign-up requires a valid, verified email address. Submitting a video requires first connecting the account on the corresponding platform (TikTok, Instagram or YouTube), which allows KRED to verify that the video belongs to you and to measure its views. The user warrants that the information provided is accurate.

4. Use of platform APIs

The Service uses the TikTok API to authenticate creators and verify ownership of videos. By connecting your TikTok account, you authorise KRED to access your basic TikTok information and the list of your public videos through the user.info.basic and video.list scopes.

The Service uses the Instagram API to authenticate creators, verify ownership of videos and measure their views. By connecting your Instagram account, you authorise KRED to access your account’s basic information, the list of your recent posts and the statistics of the videos you submit, through the instagram_business_basic and instagram_business_manage_insights scopes.

The Service uses the YouTube API (YouTube Data API v3) to authenticate creators, verify ownership of videos and measure their views. By connecting your YouTube account, you authorise KRED to access your channel and the videos you submit on a read-only basis, through the https://www.googleapis.com/auth/youtube.readonly scope. This scope does not authorise any write operation on your YouTube account.

You may revoke this access at any time by disconnecting the relevant account from your KRED profile, or from the security settings of the corresponding platform (TikTok, Instagram or Google).

5. Submitted content

By submitting the URL of a TikTok, Instagram or YouTube video, the user warrants that they are the author of the video concerned and hold all necessary rights. KRED reserves the right to moderate and reject any content that does not comply with its rules or with the rules of the campaign concerned.

6. Minimum campaign budget

Every campaign created on KRED must have a total budget of at least €100. This amount is the minimum commitment required to launch a campaign and to provision creators’ earnings. Budget requests below this threshold are refused both when the campaign is created and when it is modified.

7. Disclosure of commercial content

Every video submitted on KRED gives rise to remuneration and therefore constitutes commercial content. For each video submitted, the creator undertakes to disclose its commercial nature in a clear, legible and understandable manner, in accordance with article 5-2 de la loi n° 2023-451 du 9 juin 2023 encadrant l’influence commerciale (Article 5-2 of French Act No. 2023-451 of 9 June 2023 regulating commercial influence).

This disclosure requires both of the following:

  • activating, at the time of publication, the commercial content disclosure setting of the platform concerned — on TikTok, the “Commercial content” button, which produces the “Paid partnership” label; on Instagram, the branded content tool, which produces the “Paid partnership” label; on YouTube, in YouTube Studio (Content, then for the selected video, More options, “Content declaration” section of the advanced settings), the “My video contains paid promotion like a product placement, sponsorship or endorsement” checkbox, which, once ticked, causes YouTube to display a notice automatically at the start of the video;
  • an explicit statement in the description of the post, such as “Publicité” (Advertising) or “Collaboration commerciale” (Commercial collaboration), or any equivalent statement suited to the format used.

The creator expressly attests to this disclosure when submitting each video. This attestation is time-stamped and retained by KRED. The creator remains solely responsible for the actual compliance of their post.

Failure to disclose exposes the creator to rejection of the post, cancellation of the corresponding earning and, in the event of repeated breaches, suspension of their account under Article 14. It may also make the post ineligible for the platform’s algorithmic recommendation, reducing accordingly the views taken into account in calculating the creator’s remuneration.

8. Collaboration contract between the brand and the creator

Every participation of a creator in a campaign gives rise to the conclusion of a written commercial collaboration contract between the advertiser brand and the creator, in accordance with Article 8 of loi n° 2023-451 du 9 juin 2023 and with décret n° 2025-1137 du 28 novembre 2025 (French Decree No. 2025-1137 of 28 November 2025).

KRED is not a party to this contract. The platform provides the tool for matching and contracting, and measures the views. It acts neither as the advertiser’s agent nor as an influencer agent within the meaning of Article 7 of the same Act.

Payment of the sums owed by the advertiser under this contract passes through KRED, which collects them as the creator’s agent — not the advertiser’s — under the conditions of Article 10 (mandate to collect payments). This collection does not affect the foregoing: receiving funds on the creator’s behalf entails neither a mandate from the advertiser nor the status of influencer agent.

The contract is formed as follows:

  • by publishing its campaign, the brand undertakes to contract with any creator who joins it, on the published terms — this is the offer;
  • the creator accepts it by participating in the campaign, after having read those terms — this is the acceptance;
  • the specific terms (CPM per platform, caps, view threshold, duration, content guidelines) are fixed upon acceptance. Any subsequent modification of the campaign by the brand has no effect on contracts already concluded and applies only to creators who join afterwards.

The contract is concluded electronically. In accordance with article 1366 du code civil (Article 1366 of the French Civil Code), an electronic document has the same evidential value as a paper document. For each contract, KRED retains the full text accepted, its digital fingerprint, and the date and time of acceptance, and sends a copy to the creator by email.

The aforementioned Article 8 requires mandatory particulars, including the identity, contact details and country of tax residence of the parties. This information is requested from the creator only when the total of their remuneration from a single brand, over the current calendar year, reaches the threshold shown in their account (€500 at present) — set below the statutory threshold of €1,000 excluding tax, above which a written contract becomes mandatory on pain of nullity. The creator may not continue their collaboration with that brand until they have provided it.

No video may be submitted for a campaign whose contract has not been accepted.

In accordance with Article 8 III of the same Act, the brand and the creator are jointly and severally liable for damage caused to third parties in the performance of this contract.

9. KRED prices and platform fees

Use of the Service gives rise, for the brand and for the creator alike, to the payment of a platform fee to KRED. These platform fees remunerate the matching and the services described in the preceding articles; they are added to the sums owed to creators, they do not reduce them.

Brand platform fee. The budget entered by the brand when creating a campaign is intended entirely for the remuneration of creators. The KRED platform fee is invoiced on the committed budget, in addition to it, and remains KRED’s even if the campaign does not use it in full. The applicable rate is the one displayed to the brand when the campaign is created; it is fixed for that campaign and is not affected by any subsequent change to KRED’s default rate. Only this platform fee is invoiced: the sums paid to creators pass through on their behalf and are never invoiced; where applicable, it is for the creator to invoice the brand themselves (Article 10).

Creator platform fee. Earnings are credited to the creator’s Wallet at their gross amount, calculated in accordance with Article 12. A service fee is deducted from each withdrawal when it is executed; it is the subject of a separate invoice covering only that fee, never the sums paid to the creator. The applicable rate is the one displayed to the creator when they request the withdrawal; it is fixed for that withdrawal and is not affected by any subsequent change to KRED’s default rate.

Value added tax. Prices stated by KRED are exclusive of any applicable tax. The VAT regime applicable to KRED’s platform fees, and the amount of any tax due, are shown to the brand before payment and appear on every invoice issued. Where no tax is due, no tax amount is displayed.

10. Mandate to collect payments

For the payment of campaigns, KRED acts as the creator’s payment collection agent: on the creator’s behalf, it receives the sums paid by the brand in respect of the campaign budget, and is responsible for paying them over to the creator under the conditions of Article 12. KRED is at no time the owner of these sums.

Payment made by the brand to KRED discharges the brand in full: upon its collection by KRED, it extinguishes the brand’s payment obligation towards the creator under Article 8, without the creator having to wait for the sums to be actually paid over to their Wallet.

This mandate is free of charge: it gives rise to no remuneration separate from the platform fees described in Article 9.

It does not entail the status of agent of the advertiser, nor the status of influencer agent within the meaning of Article 7 of loi n° 2023-451 du 9 juin 2023, nor an invoicing mandate within the meaning of article 289 I 2° du code général des impôts (Article 289 I 2° of the French General Tax Code). KRED does not issue, draw up or deliver any document in the name or on behalf of the creator; the creator remains solely responsible for their tax and accounting obligations, including, where applicable, invoicing the brand themselves.

The creator may revoke this mandate at any time by closing their KRED account. This revocation has no effect on sums already collected by KRED on the creator’s behalf before closure: they remain due and are paid over to the creator under the usual conditions.

11. Ownership of funds and of the Wallet

Sums credited to the creator’s Wallet, under the conditions of Article 12, are the property of the creator as soon as they are credited. KRED holds them on the creator’s behalf, under the payment collection mandate described in Article 10, and never records them among its own assets.

KRED is therefore never the owner of the sums shown in a creator’s Wallet, including during the period provided for in Article 12 before they can be withdrawn. This period is a processing period, not a holding period on KRED’s behalf.

The platform fee deducted by KRED from a withdrawal, described in Article 9, is the price of a service provided to the creator — the execution of the withdrawal — and not a deduction from income that would belong to KRED before being paid over. It reduces only KRED’s share in the transaction, never the creator’s claim before the withdrawal is executed.

12. Earnings and Wallet

Earnings are calculated automatically on the basis of a daily count of the video’s views, carried out every day for a maximum of 30 days from its publication. Each count recording additional views may give rise to an earning, calculated from the additional views recorded that day and the campaign’s CPM, up to the limit of the campaign’s available budget and any caps it sets (per video, per creator). The amounts credited are paid into the creator’s KRED Wallet.

A credited earning can be withdrawn only after a period of 7 days from the date on which it was credited. Withdrawals are possible from a withdrawable balance of €25. The available withdrawal methods are shown to the creator in the application at the time of the request.

The amount received by the creator on a withdrawal is net of the service fee described in Article 9, which is the subject of a separate invoice from KRED. This fee does not call into question the creator’s ownership of the sums credited to their Wallet before the withdrawal is executed (Article 11).

KRED reserves the right to cancel an earning in the event of fraud, non-compliant content, breach of these Terms of Service, or deletion or unavailability of the video concerned (video deleted, made private, or made inaccessible). In the latter case, the cancellation covers earnings that could not yet be withdrawn at the time of the deletion or unavailability; earnings that have already become withdrawable are not taken back. Earnings are subject to the campaign’s available budget.

13. Brand refund policy

A brand may request the cancellation of all or part of a campaign’s unspent budget at any time until the campaign has moved to ENDED status. Beyond that point, a cash refund is no longer possible, but any remaining balance is not lost: it becomes a credit in the brand’s favour under the conditions described below.

Until the campaign is ENDED, the amount refundable in cash is the campaign’s remaining budget (total budget minus budget spent). KRED does not withhold any amount from this sum. Once the campaign is ENDED, the credit described below is calculated on a different basis: the amount actually funded by the brand, minus the budget spent — never on the announced total budget. A campaign that was never funded, or that has been spent in full, generates no credit.

The KRED platform fee collected when the campaign was funded (Article 9) remains KRED’s, including on the part of the budget ultimately refunded or converted into credit: it remunerates the opening of the campaign, not its full consumption. It is the only sum withheld by KRED under this arrangement; the credit’s validity period, described below, is not a fee but may, if not observed, deprive the brand of all or part of the remaining balance.

Any bank charges not recovered by KRED from its payment provider on the refund, where applicable, are borne by KRED and are not deducted from the amount repaid to the brand.

Cash refunds are processed via Stripe to the original card within 48 hours of approval by our team. The credit described below does not follow this route: it is credited automatically when the campaign moves to ENDED status, without any action by our team, without going through Stripe and without any link to a bank card.

Where the cancelled campaign was funded in whole or in part by a credit, the refund is split accordingly: the part paid by card returns to the original card under the conditions described above (Stripe, 48 hours); the part paid by credit cannot return to a card — no Stripe collection took place on that part — and instead becomes a new credit, credited automatically when the request is approved, without going through Stripe. This new credit inherits the expiry date of the original credit (and, where several original credits were involved, the earliest of those dates): it does not restart for a rolling 12 months. The exact amount of each part is shown to the brand before the request is confirmed, and again in the confirmation that the request has been sent.

Campaign credit. The remaining balance issued when a campaign closes (paragraph 2 above) is credited to the brand’s account as a credit, valid for a rolling 12 months from its issue. It may be used, in whole or in part, to fund any subsequent campaign of the brand: it then reduces the amount actually charged (via Stripe or, where the credit covers the full amount due, with no charge at all), but never the KRED platform fee, which is calculated on the total amount of the funded campaign, credit included (Article 9). Where a brand holds several credits, the one with the earliest expiry date is used first. A credit not used before its expiry date expires automatically and the remaining amount is permanently lost; a notification is sent to the brand one month before that expiry date.

Refunds cannot be made on earnings already confirmed in favour of creators. Any campaign with ENDED status is no longer eligible for a cash refund; what happens to any remaining balance is described above.

14. Account suspension

KRED reserves the right to suspend a creator account (ban) in the event of a breach of these Terms of Service or of fraudulent behaviour. The grounds for suspension are as follows:

  1. Fraudulent views (FAKE_VIEWS) — buying views, click farms, automated scripts.
  2. Automated account / bot (BOT_ACCOUNT) — non-human engagement detected.
  3. Duplicate video (DUPLICATE_VIDEO) — submitting the same content to several campaigns.
  4. Breach of content rules (CONTENT_VIOLATION) — content prohibited by the campaign or the platforms (hate, nudity, copyright infringement, etc.).
  5. Payment fraud (PAYMENT_FRAUD) — use of misappropriated means of payment, abusive chargebacks, false banking identity.
  6. Account takeover (ACCOUNT_TAKEOVER) — compromised account or impersonation.
  7. Circumvention (NON_CIRCUMVENTION_BREACH) — creating multiple accounts to circumvent a ban or a cap.
  8. Repeated breaches of the Terms of Service (TOS_REPEATED_VIOLATION) — accumulation of warnings without correction.
  9. Other (OTHER) — any ground stated by the KRED team and communicated to the creator.

15. Appeal procedure

A suspended creator may appeal via the link provided in the notification email, or directly on the /appeal/[ban_id] page. The deadline for submitting an appeal is 14 days from the date of suspension. After that, the decision becomes final and the account is permanently closed, subject to statutory retention obligations.

Our team responds to each appeal within 10 business days. There are three possible outcomes:

  • UPHELD — suspension maintained.
  • OVERTURNED — suspension lifted, account reactivated.
  • PARTIAL — compromise (e.g. reduced duration).

Appeal decisions are final and binding on both parties. No second appeal is possible. Any subsequent remedies are governed by applicable French law.

16. Liability

KRED cannot be held liable for any direct or indirect damage resulting from use of the Service. The Service is provided “as is”, with no guarantee that it will be uninterrupted.

With regard to the disclosure of the commercial nature of posts (Article 7), KRED is bound by a best-efforts obligation (obligation de moyens) towards brands: KRED contractually imposes this obligation on creators, collects and retains their attestation for each post, and removes any non-compliant post reported to it. KRED has no technical means of analysing the content of videos published on third-party platforms and does not guarantee the compliance of each post. It is for the brand, as advertiser, to check the posts made as part of its campaigns and to report any non-compliant post to KRED.

17. Amendments to the Terms of Service

KRED reserves the right to amend these Terms of Service at any time. A minor amendment (wording, formatting, correction) takes effect as soon as it is published on the Site.

A material amendment — in particular any new clause entailing an additional commitment or obligation for the user — requires new express acceptance. The user is notified of it and may not continue to take any binding action on the Service (submitting a video, participating in a campaign, creating a campaign) until they have accepted it.

18. Governing law

These Terms of Service are governed by French law. In the event of a dispute, the French courts shall have jurisdiction.

19. Contact

20. Reporting obligations (DAC7)

KRED is an operator of an electronic intermediation platform within the meaning of articles 1649 ter A à 1649 ter E du code général des impôts (Articles 1649 ter A to 1649 ter E of the French General Tax Code), which transpose the so-called “DAC7” directive. As such, KRED is required to collect certain information about creators who receive income through it, and to send it each year to the tax authorities.

The information concerned is: the creator’s identity (surname, first name, address, date of birth, tax identification number) and, for each quarter of the calendar year, the total amount of the sums credited to their Wallet and the amount of the platform fees withheld by KRED. This collection takes place at the creator’s first withdrawal, whatever its amount: the law allows no exemption based on the volume of sums received.

The creator undertakes to provide accurate, up-to-date information and to correct it without delay in the event of any change. As long as this information is incomplete, KRED is unable to execute a withdrawal request.

This obligation is separate from the one described in Article 8: it does not release the creator from any of their own tax and reporting obligations. By 31 January of each year at the latest, KRED sends the creator a copy of the information concerning them that it sends to the tax authorities. This document is not an invoice and does not serve as one: it is for the creator to issue their own invoices if they are required to do so.

21. Purchase of a video by a brand

A brand may offer to buy from the creator a video that the creator has submitted to one of its campaigns, at the price displayed by the creator or at a price agreed between them. This purchase is optional: it is not a condition of participating in the campaign, nor of the cost-per-thousand-views remuneration described in Article 12, which it does not replace and from which it is not deducted.

The purchase gives rise to a rights grant addendum concluded between the brand and the creator, separate from the commercial collaboration contract described in Article 8, which remains applicable in all other respects. KRED is not a party to this addendum: it provides the tool, collects the price as the creator’s payment collection agent under the conditions of Article 10, and charges the brand an intermediation fee under the conditions of Article 9.

The addendum is concluded electronically: the brand accepts it by paying the price, and the creator by uploading the source file of the video, the upload button bearing a statement of the rights grant. The creator reads its full text before uploading; the brand knows the scope of the licence granted before paying and receives its full text as soon as it is concluded. KRED retains its digital fingerprint and the date and time of each acceptance, under the same conditions as in Article 8.

The price is net to the creator. It is credited to the creator’s Wallet when the source file is uploaded and then follows the rules of Article 12 (period before withdrawal, minimum balance, service fee deducted on withdrawal), subject to the resolutory condition provided for in Article 6 of the addendum, the exercise of which by the brand suspends withdrawal of that price until the decision.

The addendum grants the brand, for that video only, a non-exclusive, perpetual, worldwide licence, on all media known on the date of its conclusion, including for paid advertising uses, and including the right to modify the video. The creator remains the holder of their copyright, retains their moral rights, remains free to exploit their video and to license it to third parties, and is required neither to remove their post nor to keep it online. The exact terms — in particular the warranties owed by the creator on the elements included in the video and the resolutory condition attached to the refund of the price — are set out in the addendum itself.

The source file uploaded by the creator is retained by KRED in private storage and delivered to the brand, which is its recipient under the addendum. This retention forms part of the performance of the addendum: it continues after the closure of the campaign concerned and after deletion of the creator’s account, for as long as the rights grant remains in effect. The details are set out in the Privacy Policy.

The price received by the creator under a rights grant addendum is income received through KRED, in the same way as their other earnings: it is included in the amounts sent to the tax authorities under Article 20, and it is taken into account in the total remuneration received from a single brand that triggers the collection of the creator’s legal identity (Article 8).

In accordance with Article 10, KRED does not issue any document in the name of the creator in respect of this purchase.

For a single payment, the brand receives two separate documents: a purchase receipt, which evidences payment of the price paid to the creator without constituting a tax document, and an invoice covering only the KRED platform fee (Article 9).
